1 · Accepting these terms

These terms apply to your use of GoodFundraising.org, operated by Good Fundraising, 919 Conference Dr., Suite 4-290, Goodlettsville, TN 37072. By using the site you accept them. If you do not, please do not use the site.

Our Privacy Policy explains what we do with personal information and forms part of these terms.

2 · What this site is

GoodFundraising.org is an informational site. Its purpose is to explain the LiveGood fundraising program to groups (schools, PTAs, sports teams, churches, non-profits, scout troops, bands and similar organizations), and to put you in touch with us so we can help you start one.

LiveGood's fundraising program is a separate program from LiveGood's affiliate program. Your organization signs up to the fundraising program: it shares product links and earns a share of what supporters spend. It does not recruit anyone, has no downline and is not enrolled in a sales network. GoodFundraising.org's own compensation comes from LiveGood's affiliate program, as set out in section 3 below, and your organization is neither part of that nor affected by it.

We do not sell anything on this site. There is no shopping cart, no checkout and no payment taken here. Products are sold, priced, shipped and supported by LiveGood, under LiveGood's own terms. We do not hold stock and we are not party to your purchase.

3 · LiveGood affiliate disclosure

GoodFundraising.org is an independent fundraising initiative and is not owned, operated, or endorsed by LiveGood. GoodFundraising.org participates in the LiveGood affiliate program and may earn commissions or other compensation when individuals purchase products or become LiveGood members through our referral links.

Participation does not increase the price paid by the customer. A portion of the compensation generated through participating purchases helps support our fundraising program and the organizations we work with.

LiveGood® and related names, trademarks, products, and services belong to their respective owners. GoodFundraising.org makes no guarantee regarding fundraising results, earnings, or income. Results vary based on participation, sales, and other factors.

4 · No earnings guarantee

Any figures on this site, including the 20% share of first orders and the 10% share of reorders, describe how the program calculates what a group earns. They are not a projection of what your group will earn, and they are not income you are promised.

What your organization actually raises depends entirely on how many customers it brings in, what those customers order, and whether they keep ordering. It could be substantial. It could be nothing. Examples, illustrations and testimonials on this site are not typical results and should not be read as a forecast.

5 · Health and product claims

Nothing on this site is medical advice, and nothing here should be used to decide whether to take a supplement. Talk to a qualified healthcare professional before starting any supplement, particularly if you are pregnant or nursing, taking medication, or managing a health condition. Product descriptions and any claims about them originate with LiveGood.

6 · Prices, prizes and program rules

Prices shown on this site are LiveGood's published retail and member prices at the time we wrote them down. Prize tiers and program rules are likewise LiveGood's. All of it can change, be withdrawn, or be varied by LiveGood without notice to us, and promotional prizes in particular rotate.

We check this information and try hard to keep it current, but LiveGood's own published terms and pricing govern — not our description of them. If the two ever disagree, theirs is correct. Please confirm anything that matters to your decision directly with LiveGood or with us before relying on it.

7 · Your responsibilities

When you submit the form or take part in the program, you agree to:

• give us information that is accurate, and keep it accurate;
• submit your own details, or details you are authorised to provide;
• have the authority to act for the organization you name, if you are signing it up;
• describe the program honestly to your supporters, and not make earnings, income or health claims on our behalf or LiveGood's;
• follow any rules your school, church, club or governing body has about fundraising, which is your responsibility and not ours;
• use the site lawfully, and not attempt to disrupt it, scrape it, or probe it for vulnerabilities.

We may decline to work with anyone, and may stop providing help, at our discretion.

8 · Signing up with LiveGood

Enrollment happens on LiveGood's website, not ours. Our Start page collects your details so we know you are coming and can help, and then sends you to LiveGood's official sign-up page.

Once you are there, you are dealing with LiveGood. The account is yours and theirs, the terms are theirs, the privacy policy is theirs, and any payment details you enter go to them. Your account must genuinely be your own. We are not a party to that relationship and cannot resolve disputes arising from it, though we will help you where we can.

9 · Trademarks and content

The text, layout and design of this site are ours. LiveGood®, its logos, product names, product photography and marketing copy belong to LiveGood or its licensors and are used here to describe the program. Other names and marks belong to their respective owners. Nothing on this site grants you a license to use anyone's trademarks.

Please do not copy this site or republish substantial parts of it without asking. If you believe something here infringes your rights, email us and we will look into it promptly.

10 · Links to other sites

We link to LiveGood and may link elsewhere. We do not control those sites and are not responsible for their content, their accuracy or their privacy practices. A link is not an endorsement of everything on the far side of it.

11 · Disclaimers

The site is provided "as is" and "as available". We do not warrant that it will be uninterrupted or error-free, that every detail is current, or that it will meet your particular needs. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

Some jurisdictions do not allow certain warranties to be excluded, so parts of this section may not apply to you.

12 · Limitation of liability

To the fullest extent permitted by law, Good Fundraising and the people who work with it will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue or lost fundraising income, arising out of your use of this site or your participation in the program.

Nothing here limits liability that cannot lawfully be limited, including liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by negligence.

13 · Governing law

These terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Tennessee, and you and we each consent to those courts. If any provision of these terms is found unenforceable, the rest continues to apply.

14 · Changes

We may update these terms. When we do, we will change the date at the top of this page. Continuing to use the site after a change means you accept the updated terms.
